ARREST: ROSEN, PHILIP ALAN – (1) COUNT OF DUI – INFLUENCE OF DRUG OR COMB OF DRUGS and 4 – Montgomery County

On April 16, 2022, officers responded to Pine and Lamplighter Roads for a report of a vehicle accident. Dispatch informed police the vehicle was on its side and blocking traffic.

As officers approached the scene, a white SUV was observed lying on its driver’s side. The white SUV was the only vehicle involved in the crash, and it appeared to have come into contact with the guy wire on a utility pole and rolled onto its driver’s side.

Officers observed a male, later identified as Philip Rosen, wearing a blue Philadelphia 76ers jersey. Rosen stated he was “coming up the road, and he must have hit the pole”, coming from a Sixers game.

While speaking with Rosen, officers observed his eyes were glassy and bloodshot, and his pupils were constricted and slow to react to the light from the officers flashlight. Through training and experience, officers recognized these as signs of impairment/intoxication by substances. Officers also located a green leafy substance inside the vehicle’s center console and seats, as well as on the ground just outside the vehicle was a small red container of medical marijuana. The prescription label on the jar was issued to Philip Rosen, to which Rosen confirmed to be a prescription medical marijuana. ROSEN admitted to smoking marijuana before the 76ers game and using other prescription medications.

Based on the officers investigation, they believe ROSEN was under the influence of drugs/controlled substances, which rendered him incapable of safe driving. He was arrested for a DUI.
