Guard's Failure to Check on Overdosing Inmate Not Indifference – Bloomberg Law

A jail guard in Detroit wasn’t deliberately indifferent when he didn’t physically inspect a holding cell as required by jail policy and therefore didn’t notice that an inmate with illegal drugs hidden in his rectum was overdosing, the Sixth Circuit said.
Deandre Lipford was arrested on an outstanding warrant and placed in the jail’s holding area around 10:00 p.m. Lipford denied having any drugs on him, but around 11:00 p.m., he slid to the floor and passed out.
A jail employee found Lipford unresponsive around 2:50 a.m. He was rushed to the hospital, where cocaine, heroin, and fentanyl were found …
